General Terms of Use

1. Presentation of the service

Postfast is a mobile application published by Thibaut Diesbecq, auto-entrepreneur (French self-employed sole trader), whose registered office is located in France (hereinafter “the Publisher”).

Postfast allows users to automatically generate resale listings from photographs of items, using artificial intelligence technologies. The service produces a title, a description, a price estimate and hashtags to make publishing on online selling platforms easier.

2. Acceptance of the terms

Using the Postfast application implies full and unreserved acceptance of these general terms of use. By creating an account, the user acknowledges having read these terms and accepts them without reservation.

The Publisher reserves the right to amend these terms at any time. Users will be informed of any changes by a notification within the application. Continuing to use the service after such notification constitutes acceptance of the new terms.

3. Registration and user account

Using Postfast requires the creation of an account with a valid email address and a password. The user undertakes to provide accurate information and to keep their login credentials confidential.

The user is solely responsible for the use made of their account. Any activity carried out from their account is deemed to have been performed by them. If fraudulent use is suspected, the user must inform the Publisher without delay.

4. Description of the service

4.1 Main features

Postfast offers the following features:

• Taking photos of items (up to 20 photos per item)
• Automatic analysis of the photos by artificial intelligence (vision models)
• Generation of a title, a description, a price estimate and hashtags
• Customisation of the tone, the level of detail and the style of the listings
• Links to comparable sales on the main platforms
• History and management of generated listings
• Tracking of purchases, sales, stock and margins (profitability), with CSV import/export
• Direct publishing to eBay for connected eBay accounts (optional, via OAuth)

4.2 Limits of the service

Content generated by artificial intelligence is provided as suggestions. The user remains solely responsible for the content they publish on third-party selling platforms. The Publisher does not guarantee the accuracy of price estimates, nor the completeness of the descriptions generated.

For most platforms, Postfast does not publish listings directly: the user carries out the publication themselves by copy-paste. For eBay, the user may connect their own account (through the official OAuth authorisation protocol) in order to publish directly from the application; this connection is optional and can be revoked at any time.

5. Plans and pricing

Postfast offers two plans:

• Free: free of charge, limited to 5 listing generations per month (a one-off bonus of additional generations may be offered on sign-up). All features are included.
• PostFast Plus: €6.99 per month or €69.99 per year (launch price), generations and estimates without limits, subject to reasonable use. This price may increase for new subscribers; current subscribers keep their price for as long as their subscription remains active.

Subscriptions are managed through the App Store (Apple) or Google Play and renew automatically, unless cancelled at least 24 hours before the end of the current period, from your App Store or Google Play account settings. Prices are shown in euros, inclusive of all taxes. The Publisher reserves the right to change its prices at any time, users being informed in advance of any change.

6. Intellectual property

The Postfast application, its source code, its design, its logos and its visual identity are the exclusive property of the Publisher and are protected by French and international intellectual property law.

Content generated by the AI from the user’s photos may be freely used by the user to publish their listings. The user retains full ownership of their photos and of the content they create through the service.

7. User obligations

The user undertakes to:

• Use the service in accordance with its purpose and with applicable law
• Not attempt to circumvent the technical limitations of the service (quotas, rate limiting)
• Not use the service to generate listings for illegal, counterfeit or stolen items
• Not resell or redistribute the generated content for commercial purposes other than selling their own items
• Comply with the terms of use of the selling platforms on which they publish

8. Liability

The Publisher implements all reasonable means to ensure the proper functioning of the service. However, the Publisher cannot be held liable for:

• Temporary interruptions of the service for maintenance or updates
• The inaccuracy of content generated by artificial intelligence
• The consequences of the user’s use of the generated content
• Disputes between the user and buyers on third-party selling platforms
• Malfunctions related to third-party services (OpenAI, selling platforms, etc.)

9. Termination

The user may delete their account at any time from the application settings. Deleting the account results in the deletion of all associated data within 30 days.

The Publisher reserves the right to suspend or delete any account in the event of a breach of these terms, after notifying the user except in cases of urgency.

10. Governing law and disputes

These terms are governed by French law. In the event of a dispute, the parties undertake to seek an amicable solution before any legal action. Failing that, the French courts shall have sole jurisdiction.

In accordance with the provisions of the French Consumer Code (Code de la consommation), the user may refer the matter to a consumer mediator. The mediator’s contact details will be provided on request.
